These Terms of Service ("Terms") govern your use of Sched3 ("the Service"), operated by Sched3 ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms.
Sched3 is a capital-gains calculation and tax-organization tool for Canadian investors. We compute adjusted cost base (ACB), detect superficial losses, reconcile T5008/T3/T5 slips, convert USD transactions at Bank of Canada rates, and produce Schedule 3-ready tax packages.
Sched3 is not an accounting firm, tax advisor, or financial planner. The Service provides calculations based on CRA rules as we understand them, but does not constitute tax, legal, or financial advice. You are responsible for confirming all figures with a qualified professional before filing.
You must be at least 18 years old and a Canadian resident (or have Canadian tax filing obligations) to use the Service. By creating an account, you represent that you meet these requirements.
You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account and keep it up to date. You agree not to share your account with others or allow unauthorized access.
You agree not to:
The Service, including its design, code, calculators, guides, and documentation, is owned by Sched3 and protected by Canadian and international intellectual property laws. Your subscription grants you a personal, non-exclusive, non-transferable license to use the Service.
You retain full ownership of your data. We claim no intellectual property rights over the transaction data or tax packages you generate through the Service.
The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding the accuracy of calculations, fitness for a particular purpose, or uninterrupted availability.
Tax rules are complex and subject to change. While we strive for accuracy, you acknowledge that:
To the maximum extent permitted by law, Sched3 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, tax penalties, interest charges, or reassessment costs arising from your use of the Service.
Our total liability for any claim arising from or related to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim.
Paid subscriptions are billed in advance on a recurring basis (monthly or annually, as selected). Payment is processed securely by Stripe. By subscribing, you authorize us to charge your payment method at the beginning of each billing cycle.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not offer prorated refunds for partial billing periods.
We reserve the right to change pricing with at least 30 days' notice. Price changes apply to the next billing cycle after the notice period.
You may delete your account at any time from your settings page. We may suspend or terminate your access if you violate these Terms or engage in conduct that harms the Service or other users. Upon termination, your data will be deleted in accordance with our Privacy Policy.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Ontario.
We may update these Terms from time to time. If we make material changes, we will notify you via email or a prominent notice within the application at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
